Zypherion é um protocolo descentralizado e de código aberto, desenvolvido em conjunto pela COL (Circle of Liquidity) e pela Financial Optimized Access, operado e mantido por uma rede global de colaboradores independentes. O protocolo, seus contratos inteligentes, SDKs e ferramentas associadas são fornecidos "no estado em que se encontram" e "conforme disponíveis", sem quaisquer garantias, representações ou garantias, expressas ou implícitas, incluindo, entre outras, comercialização, adequação a uma finalidade específica e não violação.

Ao acessar ou usar o Zypherion, você reconhece e concorda que:

1. Sem Controle Centralizado – A Zypherion não é uma empresa, entidade legal ou provedora de serviços centralizada. Nenhuma parte controla o protocolo ou pode modificar unilateralmente registros ou transações baseados em blockchain.

2. Sem garantia de disponibilidade – Não garantimos que o protocolo, suas interfaces ou quaisquer serviços associados serão ininterruptos, oportunos, seguros ou livres de erros.

3. Riscos da Blockchain – As transações, uma vez confirmadas na blockchain, são irreversíveis. Certas informações, incluindo histórico de transações e interações com contratos inteligentes, podem ser permanentemente públicas.

4. Riscos de Segurança – Embora a Zypherion implemente criptografia, tecnologia de prova de conhecimento zero e mecanismos de controle de acesso, nenhum sistema está imune a vulnerabilidades, ataques maliciosos ou falhas inesperadas. Os usuários são os únicos responsáveis por proteger suas carteiras, chaves privadas e informações confidenciais.

5. Sem responsabilidade – Até a extensão máxima permitida por lei, os colaboradores, mantenedores e afiliados da Zypherion se isentam de toda responsabilidade por quaisquer danos diretos, indiretos, incidentais, especiais ou consequentes, incluindo, mas não se limitando a, perda de fundos, perda de dados, interrupção de negócios ou danos à reputação decorrentes do uso ou da incapacidade de uso do protocolo.

6. Conformidade regulatória – Os usuários são os únicos responsáveis por garantir que seu uso do Zypherion esteja em conformidade com todas as leis e regulamentações aplicáveis em sua jurisdição, incluindo aquelas relacionadas à privacidade, proteção de dados e ativos digitais.

Welcome to Zypherion, a decentralized privacy-preserving storage protocol built on Solana. By accessing or using Zypherion, its website (zypherion.io), smart contracts, SDKs, or any associated tools and services (collectively, the “Protocol”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you must not use the Protocol.

1. Nature of the Protocol

1.1 Decentralized Infrastructure – Zypherion is jointly initiated by COL (Circle of Liquidity) and Financial Optimized Access, and operated by a global network of independent contributors.

1.2 No Centralized Control – There is no single legal entity controlling Zypherion. The Protocol runs on decentralized infrastructure, and certain records (including transactions and permissions) are stored permanently on the blockchain.

1.3 Open Source – The Protocol’s source code is available under open-source licenses, allowing public review and contribution.

2. Eligibility

2.1 You must be at least 18 years old or the age of majority in your jurisdiction to use Zypherion.

2.2 By using the Protocol, you represent that your use complies with all applicable laws and regulations in your jurisdiction.

3. Acceptable Use

When using Zypherion, you agree not to:

• Upload or share content that violates applicable laws or infringes the rights of others.

• Use the Protocol to engage in illegal activities, including money laundering, terrorism financing, or distribution of prohibited content.

• Attempt to hack, disrupt, or interfere with the Protocol’s security or operations.

• Misuse governance mechanisms to harm the Protocol or its community.

4. Privacy & Data

4.1 Client-Side Encryption – All data uploaded via the Protocol is encrypted on the client side; Zypherion does not store or have access to plaintext data.

4.2 Public Blockchain Records – Certain actions (e.g., transactions, access logs) are permanently recorded on the Solana blockchain and cannot be deleted or altered.

4.3 Privacy Policy – Your use of the Protocol is also governed by our Privacy Policy, which explains how we handle and protect information.

5. Governance

5.1 The Protocol’s parameters, upgrades, and ecosystem initiatives are determined by ZPHR token holders through decentralized governance.

5.2 DAO governance proposals and voting results are recorded on-chain and are binding according to the governance rules.

6. No Financial Advice

Nothing provided by Zypherion constitutes legal, financial, or investment advice. You should seek independent advice before engaging in activities involving digital assets.

7. Disclaimers & Limitation of Liability

7.1 “As Is” Basis – The Protocol is provided on an “as is” and “as available” basis without warranties of any kind.

7.2 No Guarantee – We do not guarantee uninterrupted, secure, or error-free access to the Protocol.

7.3 Security Risks – While Zypherion implements encryption and zero-knowledge proof technology, no system is immune to vulnerabilities, attacks, or failures.

7.4 No Liability – To the maximum extent permitted by law, Zypherion’s contributors, maintainers, and affiliates disclaim all liability for any damages, losses, or claims arising from the use or inability to use the Protocol.

8. User Responsibilities

8.1 You are solely responsible for safeguarding your wallet, private keys, and any sensitive credentials.

8.2 You acknowledge that losing your private keys will result in the loss of access to your assets and data without recovery options.

9. Changes to Terms

We may update these Terms at any time. Changes will be posted on this page with the updated “Last Updated” date. Continued use of the Protocol after changes means you accept the revised Terms.

10. Governing Law

These Terms are governed by the applicable laws of the jurisdiction where you reside, to the extent not inconsistent with the decentralized nature of the Protocol.
