Zypherion is an open-source, decentralized protocol jointly initiated by COL (Circle of Liquidity) and Financial Optimized Access, operated and maintained by a global network of independent contributors. The protocol, its smart contracts, SDKs, and associated tools are provided “as is” and “as available” without any warranties, representations, or guarantees, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
By accessing or using Zypherion, you acknowledge and agree that:

No Centralized Control – Zypherion is not a company, legal entity, or centralized service provider. No single party controls the protocol or can unilaterally modify blockchain-based records or transactions.

No Guarantee of Availability – We do not guarantee that the protocol, its interfaces, or any associated services will be uninterrupted, timely, secure, or error-free.

Blockchain Risks – Transactions, once confirmed on the blockchain, are irreversible. Certain information, including transaction history and smart contract interactions, may be permanently public.

Security Risks – While Zypherion implements encryption, zero-knowledge proof technology, and access control mechanisms, no system is immune to vulnerabilities, malicious attacks, or unexpected failures. Users are solely responsible for safeguarding their wallets, private keys, and sensitive information.

No Liability – To the maximum extent permitted by law, Zypherion’s contributors, maintainers, and affiliates disclaim all liability for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of funds, loss of data, business interruption, or reputational harm arising from the use of or inability to use the protocol.

Terms & Conditions - The Basics

Welcome to Zypherion, a decentralized privacy-preserving storage protocol built on Solana. By accessing or using Zypherion, its website (zypherion.io), smart contracts, SDKs, or any associated tools and services (collectively, the “Protocol”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you must not use the Protocol.
1. Nature of the Protocol
1.1 Decentralized Infrastructure – Zypherion is jointly initiated by COL (Circle of Liquidity) and Financial Optimized Access, and operated by a global network of independent contributors.
1.2 No Centralized Control – There is no single legal entity controlling Zypherion. The Protocol runs on decentralized infrastructure, and certain records (including transactions and permissions) are stored permanently on the blockchain.
1.3 Open Source – The Protocol’s source code is available under open-source licenses, allowing public review and contribution.
2. Eligibility
2.1 You must be at least 18 years old or the age of majority in your jurisdiction to use Zypherion.
2.2 By using the Protocol, you represent that your use complies with all applicable laws and regulations in your jurisdiction.
3. Acceptable Use
When using Zypherion, you agree not to:

4. Privacy & Data
4.1 Client-Side Encryption – All data uploaded via the Protocol is encrypted on the client side; Zypherion does not store or have access to plaintext data.
4.2 Public Blockchain Records – Certain actions (e.g., transactions, access logs) are permanently recorded on the Solana blockchain and cannot be deleted or altered.
4.3 Privacy Policy – Your use of the Protocol is also governed by our Privacy Policy, which explains how we handle and protect information.
5. Governance
5.1 The Protocol’s parameters, upgrades, and ecosystem initiatives are determined by ZPHR token holders through decentralized governance.
5.2 DAO governance proposals and voting results are recorded on-chain and are binding according to the governance rules.
6. No Financial Advice
Nothing provided by Zypherion constitutes legal, financial, or investment advice. You should seek independent advice before engaging in activities involving digital assets.
7. Disclaimers & Limitation of Liability
7.1 “As Is” Basis – The Protocol is provided on an “as is” and “as available” basis without warranties of any kind.
7.2 No Guarantee – We do not guarantee uninterrupted, secure, or error-free access to the Protocol.

8. User Responsibilities
8.1 You are solely responsible for safeguarding your wallet, private keys, and any sensitive credentials.
8.2 You acknowledge that losing your private keys will result in the loss of access to your assets and data without recovery options.
9. Changes to Terms
We may update these Terms at any time. Changes will be posted on this page with the updated “Last Updated” date. Continued use of the Protocol after changes means you accept the revised Terms.
10. Governing Law
These Terms are governed by the applicable laws of the jurisdiction where you reside, to the extent not inconsistent with the decentralized nature of the Protocol.
